Acceptable Use Policy

Éphé exists to turn the photos you love into art. To keep that experience safe for everyone (especially children, the people in your photos, and our team), we ask you to follow this Acceptable Use Policy. It is part of our Terms of Service and applies every time you use our Services.

This policy applies to every photo, image, text, instruction, or other content you upload to Éphé ("User Content").

What you may not upload

You may not upload, submit, or otherwise provide any User Content that falls into any of the categories below. This list is not exhaustive. We may refuse, remove, or report content for any reason, in our sole discretion.

1. Child sexual abuse material (CSAM) and content that sexualizes minors

You may never upload content that depicts, describes, or alludes to the sexual abuse, exploitation, or sexualization of any person under the age of 18. This includes both real and fictional or AI-generated depictions. We treat this category with zero tolerance.

When we detect or suspect this content, we will:

  • Block the upload and refuse to generate any artwork from it.
  • Preserve the content as required by law.
  • Report it to the National Center for Missing and Exploited Children's CyberTipline, as required under 18 U.S.C. § 2258A.
  • Permanently terminate the account.
  • Cooperate with law enforcement.

2. Sexually explicit content and nudity

You may not upload pornography, sexually explicit content, or non-consensual intimate imagery. You also may not upload nude or partially nude images of any identifiable adult without their documented consent. Educational, medical, or artistic nudity is not permitted on the Services.

If you are the person depicted in non-consensual intimate imagery on our Services (or are authorized to act on their behalf), see our Intimate Image Takedown Policy for the fastest way to have it removed.

3. Violence, gore, and abuse

You may not upload content that depicts:

  • Real or graphic violence against people or animals.
  • Self-harm, suicide, or content that promotes or glorifies either.
  • Abuse, including domestic abuse, child abuse, animal abuse, or elder abuse.
  • Severe injury, dismemberment, or death.

4. Hate and harassment

You may not upload content that promotes or incites hatred, violence, or discrimination against any person or group based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, age, disability, or any other characteristic protected by law. You may not upload content intended to harass, threaten, or intimidate any person.

5. Real persons without consent

You may not upload identifiable photos of any person (other than yourself) unless you have their consent to upload that photo and have it transformed into artwork. For minors, you must be the parent or legal guardian of the minor depicted, or otherwise authorized to provide that consent.

You may not upload photos of public figures (celebrities, politicians, athletes, or others) for the purpose of creating artwork that suggests their endorsement, association, or participation in any product, cause, or activity.

6. Content that infringes someone else's rights

You may not upload content that you do not own or do not have permission to use. This includes:

  • Photographs taken by someone else (a photographer, a stock library, or a stranger) unless you have a license or permission to use the photo as User Content.
  • Copyrighted artwork, illustrations, characters, or designs.
  • Trademarks, logos, or brand assets that you do not have rights to use.
  • Content that has been the subject of a takedown notice or court order.

If you are unsure whether you have rights to a photo, do not upload it. Our DMCA Policy describes how rightsholders can submit copyright complaints.

7. Personal information and sensitive documents

You may not upload content that contains the personal information of others (such as their address, phone number, financial information, or government identification) without their consent. You may not upload images of:

  • Government-issued identification (driver's licenses, passports, ID cards).
  • Financial documents (credit cards, account statements, checks).
  • Medical records or other protected health information.

8. Illegal activity, weapons, and dangerous items

You may not upload content that depicts or promotes:

  • Illegal drugs or drug paraphernalia.
  • Weapons (firearms, explosives, or similar) in a context that promotes violence.
  • Wildlife trafficking, poaching, or other illegal activity.
  • Content related to terrorism, violent extremism, or organized criminal activity.

9. Misleading and deceptive content

You may not upload content for the purpose of impersonating any person or entity, creating fraudulent documents, deceiving any third party, or generating content that could be mistaken for an authentic photograph (such as a fabricated news image or evidence).

10. Anything else that is unlawful or harmful

You may not upload content that violates any applicable law or that we determine, in our sole discretion, is harmful, offensive, or otherwise inconsistent with the spirit of this policy.

How we enforce this policy

Automated screening. We screen uploaded content using automated tools that look for the categories above. Some content may be blocked at upload. Some may be queued for human review before generation begins.

Human review. Our team may review flagged content and may also review content reported by other users.

Outcomes. When we find a violation, we may take any of the following actions:

  • Refuse to generate artwork from the content.
  • Cancel any pending order, with or without a refund (a refund is not guaranteed for orders cancelled because of a violation).
  • Remove content from your account and from the Services.
  • Suspend your account for a period of time.
  • Permanently terminate your account.
  • Preserve evidence of the violation as required by law.
  • Report the violation to law enforcement or to organizations such as the National Center for Missing and Exploited Children.

For violations of Section 1 (CSAM), termination and reporting are mandatory, not discretionary.

Repeat infringers. Accounts that repeatedly violate this policy or our DMCA Policy will be terminated.

How to report a violation

If you see User Content or generated artwork on the Services that you believe violates this policy, email us at hello@ephe.art with the subject line "Acceptable Use Report." Please include:

  • A description of the content and where you saw it.
  • Why you believe it violates this policy.
  • Your contact information so we can follow up if needed.

Reports are reviewed by our team. If the content involves an immediate safety concern (such as content depicting a child in danger), please also contact your local law enforcement or, in the United States, the National Center for Missing and Exploited Children CyberTipline at 1-800-843-5678.

For non-consensual intimate imagery (including AI-generated depictions), use our Intimate Image Takedown Policy. That procedure has a 48-hour removal commitment and is the fastest path.
