Intimate Image Takedown Policy

This policy explains how to ask Éphé to remove intimate imagery of you (or someone you are authorized to represent) from our Services. It is the procedure we follow to comply with the federal Take It Down Act (15 U.S.C. § 6851 et seq., as amended) and applicable state laws covering non-consensual intimate imagery ("NCII").

This policy is in addition to our Acceptable Use Policy, which already prohibits uploading NCII to our Services.

What this policy covers

This policy covers content that:

  • Shows an identifiable person who is nude, partially nude, or engaged in sexual conduct, and
  • Was created, shared, or transformed without that person's consent.

It applies to both authentic photographs and to artwork, edits, or other depictions generated by Éphé from a photograph, including any AI-generated or "deepfake" depiction.

It applies whether the content is of an adult or a minor. If the content depicts a minor, see also Section 1 of our Acceptable Use Policy and the NCMEC CyberTipline for additional reporting paths.

Who may submit a removal request

You may submit a removal request if:

  • You are the person depicted in the content.
  • You are the parent or legal guardian of a minor depicted in the content.
  • You are an authorized representative (such as an attorney) acting on behalf of the depicted person.

How to submit a removal request

Email us at hello@ephe.art with the subject line "Intimate Imagery Removal Request."

Please include the following information so we can act quickly:

  1. Your name and contact information (email and, optionally, phone number).
  2. Your relationship to the person depicted. If you are not the person depicted, briefly describe your authorization (parent, legal guardian, attorney, etc.).
  3. A description of the content you want removed, and where it appears on our Services if you know (a URL, an order number, or a screenshot is helpful).
  4. A good-faith statement that the content shows you (or the person you represent) and was created, shared, or transformed without that person's consent.
  5. A signature (typed is acceptable) and the date.

You do not need to send us a copy of the content itself. If you do, we will preserve it only as long as needed to act on the request.

What we will do

When we receive a request that includes the information above, we will:

  1. Acknowledge receipt by email, usually within two business days.
  2. Review the request and the content it describes.
  3. Remove or disable access to the content within 48 hours of receiving a valid request, as required by the Take It Down Act.
  4. Make reasonable efforts to identify and remove any known copies of the same content on our Services.
  5. Notify you when removal is complete.

If we need more information to act on a request, we will tell you what we need and pause the 48-hour window until we have it.

If the content depicts a minor and we have reason to believe it constitutes child sexual abuse material, we will also report it to the National Center for Missing and Exploited Children's CyberTipline under 18 U.S.C. § 2258A and preserve the content as required by law.

Confidentiality

We treat removal requests as confidential. We will not publish your name, your contact information, or the details of your request. We may share the request with our service providers (such as our hosting provider or law enforcement, if required) to act on it.

False or bad-faith requests

Submitting a knowingly false removal request, or submitting a request to remove content that you do not have a good-faith basis to believe is non-consensual intimate imagery, may violate federal or state law and may result in liability. We may decline future requests from someone who has submitted false reports.

Other ways to report

The procedure above is the fastest way to remove NCII from our Services. You can also:

  • Submit a general report under our Acceptable Use Policy.
  • Submit a copyright complaint under our DMCA Policy if the content also infringes your copyright.
  • Contact your local law enforcement.
  • Report to the NCMEC CyberTipline (1-800-843-5678) if the content involves a minor.

Using one of these other paths does not affect your rights under this policy.
